Dear Madam President, receive warm greetings from the 200 human rights defenders, movements, collectives, and national as well as international organizations that have signed this letter.

We address you, as the highest representative of popular sovereignty in Mexico, following the unjust detention and imprisonment of Amuzga defender Kenia Hernández Montalván, taken place five years ago on October 18. It has been 61 months since Kenia was forced to interrupt the essential work she was doing accompanying survivors of gender-based violence, defending the land, the territory, Indigenous Peoples, and the rights of people unjustly deprived of their liberty. It has been 1,870 days since her underage children were deprived of her presence and care, and 56 days since her mother, Ynés Montalván Herrera, passed away on September 7, without the defender being allowed to attend the funeral to bid her farewell and embrace her children, who had just lost their grandmother and primary caregiver. 

During these five years, the defender has faced particularly severe judicial harassment, with 11 criminal proceedings for fabricated crimes in different Mexican states. In two of them, she has been sentenced to more than 21 years in prison, and three of the cases against her for the crime of attacks against general communication channels have been dismissed.

During this period, multiple organizations have reported that Kenia Hernández's case has been marked by the misuse of criminal law against her. These claims are based on the lack of grounds for her conviction and the irregularities and arbitrariness during the court proceedings against her. Among other things, she has been denied the right to participate in person in her hearings, the right to interpretation in the Amuzgo language, and, in addition, visits from her family, legal team, and organizations that support her have been repeatedly prevented.

All of this, combined with the conditions in which she has been deprived of her liberty, has led the Amuzgo lawyer to go on two hunger strikes, the first on May 17, 2021, which lasted 21 days, and the second on October 17, 2021, which lasted 61 days. These protests have also deepened her vulnerability and risk.

It should be noted that Caminos y Puentes Federales (CAPUFE) has been repeatedly urged to reach a reparatory agreement, but this has not yet materialized.

We also recall that in January of this year, Joel Hernández, Kenia's son, delivered a letter to you about the case and requested that you review it in order to secure his mother's release, a request that you agreed to review.

Madam President, five years after Kenia's unjust imprisonment, it is urgent to make tangible and effective the commitment you have made to the Mexican people to continue advancing in the transformation of the country, particularly in relation to those situations of violence and discrimination that reproduce historical patterns of persecution and cruelty against indigenous peoples and, especially, against women.

 Today, we, the undersigned, warn that the injustice, cruelty, and inhumanity continue to worsen every passing day, and the irreparable impacts and damage continue to accumulate for the Amuzga defender, her family, her community, and all the people and projects she supports. The time is now!
